I have personal knowledge that Mumia Abu-Jamal did not shoot police officer Faulkner.&lt;br /&gt;I was hired, along with another guy, and paid to shoot and kill Faulkner. I had heard that Faulkner was a problem for the mob and corrupt policemen because he interfered with the graft and payoffs made to allow illegal activity including prostitution, gambling, drugs without prosecution in the center city area.&lt;br /&gt;Faulkner was shot in the back and then in the thee before Jamal came on the scene. Jamal had nothing to do with the shooting.&lt;br /&gt;Before the shooting, I was shown a picture of Faulkner and told that Faulkner was supposed to check something at Johnny Os (at 13th and Locust) sometime in the early morning hours of December 9.&lt;br /&gt;Two of us were hired for the shooting so that either of us could take the opportunity to make the hit, get the job done, and leave. The other guy gave me a .38 caliber policeman's special and I was also carrying my own .22 caliber revolver.&lt;br /&gt;I waited at the speedline entrance at the north east of corner of Locust and 13th at the parking lot, I was wearing a green (camouflage) army jacket. The other guy waited on the south side of Locust street east of 13th Street towards Camac Street.&lt;br /&gt;While I was waiting at the speedline entrance for Faulkner to arrive at the location, I saw police officers in the area. Two undercover policemen were standing on the west side of 13th north of Locust. Also a uniformed police officer was sitting in a car in the corner of the parking lot, They were there while the shooting of Faulkner took place. I was not worried about the police, being there since I believed that since I was hired by the mob to shoot and kill Faulkner, any police Officers on the scene would be there to help me.&lt;br /&gt;After a while I saw Faulkner get out of a small police car parked behind a VW parked on Locust Street, east of 13th. Faulkner was alone. He got out of the police car end went up to the VW, I heard a shot ring out coming from east on Locust Street, Faulkner fell on his knee on the sidewalk next to the VW, I heard another shot and it must have grazed my left shoulder. I felt something hard on my left shoulder. I grabbed at my shoulder and got blood on my hand.&lt;br /&gt;I ran across Locust Street and stood over Faulkner, who had fallen backwards on the sidewalk, I shot Faulkner in the face at close range. Jamal was shot shortly after that by a uniformed police officer who arrived on the scene.&lt;br /&gt;Cop Cars came from all directions. Foot patrol also arrived. I saw a white shirt getting out of a car in the middle of the 13th &amp;amp; Locust intersection just as I was going down to the speedline Steps.&lt;br /&gt;I left the area underground through the speedline system and by pro-arrangement met a police officer who assisted me, exited the speedline underground about three blocks away. A car was waiting for me and I left the center city area.&lt;br /&gt;The foregoing is stated subject to the penalties of 15 Pa.C.S. In late March, a three-judge panel of the Third Circuit affirmed Abu-Jamal's conviction but vacated the death sentence. The court said Abu-Jamal should be sentenced to life in prison or get a chance to persuade a new Philadelphia jury that he deserves a life sentence rather than death.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span&gt;Defense lawyer Robert R. Bryan of San Francisco intends to seek a rehearing before the court on his contention that Abu-Jamal deserves a new trial, or at least a hearing on his argument that some blacks were intentionally excluded from his jury. The court said the new filing deadline is June 10.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="color: rgb(255, 204, 0);"&gt; *- Emilie Lounsberry* &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span&gt;On March 27 the U.S. Court of Appeals court ordered a new jury trial on whether Mumia should be sentenced to life or death because of the trial judge’s unconstitutional jury instructions. Mumia remains on death row since the ruling has not taken effect and the prosecution has vowed to appeal and continue its quest to see him executed. It is always good when there is a determination that the death penalty was wrongfully imposed, especially where, as here, it could help other inmates sentenced to death. Yet, we are not pleased with the ruling because the court refused to reverse the conviction and order a new trial on the question of innocence. The indisputable facts are that the prosecutor engaged in racism to select the jury, made a misleading argument to the jury which turned the concept of reasonable doubt on its head, and the trial judge was biased.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span&gt;The bright side of the federal decision is that Justice Thomas L. Ambro wrote a lengthy dissenting opinion on the issue of racism in jury selection. His first sentence set the tone: “Excluding even a single person from a jury because of race violates the Equal Protection Clause of our Constitution.” He concluded that the “core guarantee of equal protection, ensuring citizens that their State will not discriminate on account of race, would be meaningless were we to approve the exclusion of jurors on the basis of . . . race. . . . Bryan of San Francisco, said he planned to ask the U.S. Supreme Court to consider the case.&lt;br /&gt;&lt;br /&gt;In March, a three-judge panel of the Third Circuit left intact Abu-Jamal's conviction but said a new jury should decide whether he deserved death or should be sentenced to life behind bars.&lt;br /&gt;&lt;br /&gt;Deputy District Attorney Ronald E. Eisenberg said no decision had been made on whether his office would ask the high court to reinstate the death sentence.&lt;br /&gt;&lt;br /&gt;Abu-Jamal and his lawyers contend that the panel should have ordered a hearing on their contention that prosecutors intentionally excluded blacks from his jury in violation of a later 1986 U.S. Supreme Court decision.&lt;br /&gt;&lt;br /&gt;They noted that one of the panel members, Judge Thomas Ambro, wanted a hearing held on that issue, though he was in the minority on that issue.&lt;br /&gt;&lt;br /&gt;All three members of the panel, which also included Chief Judge Anthony J. Scirica and Judge Robert E. Cowen, affirmed the December 2001 decision by U.S. District Judge William H. Yohn Jr., who threw out the death sentence.&lt;br /&gt;&lt;br /&gt;Yohn concluded that the jury might have been confused by the trial judge's instructions and wording on the verdict form filled out when the jury decided on death.&lt;br /&gt;&lt;br /&gt;He found that the jury might have mistakenly believed it had to agree unanimously on any mitigating circumstances - factors that might have persuaded the jury to decide on a life sentence, rather than death.&lt;br /&gt;&lt;br /&gt;Abu-Jamal, 54, has been on death row since his 1982 conviction in the killing of Faulkner, who was shot to death near 13th and Locust Streets early on Dec. 9, 1981.&lt;br /&gt;&lt;br /&gt;The Pennsylvania Supreme Court upheld his conviction and death sentence in 1989, and also rejected three other appeals.&lt;br /&gt;&lt;br /&gt;Unless the nation's high court agrees to hear the case, Abu-Jamal most likely would face a new Philadelphia jury to decide only whether the penalty should be life or death.
